Boarding Agreement (including all exhibits and amendments, this “Agreement”), dated:

Background

This Agreement provides for the boarding of a Dog by the Caregiver with the Dog belonging to the Client.
Accordingly, the parties agree as follows:

Article 1 - Definitions

1.1 Definitions.

The terms defined in the preamble and recital have their assigned meanings, and each of the following terms has the meaning assigned to it:

"Dog Drop Off Date" - means the date when the Client drops the Dog off with the Caregiver, or the Caregiver picks the Dog up from the Client.

"Dog Pick Up Date" - means the date when the Client receives the Dog from the Caregiver.

"Boarding Period" - has the meaning assigned to it in Section 3.1.

"Costs" - has the meaning assigned to it in Section 4.4.

Article 2 - Boarding of the Dog

2.1 Hiring of the Caregiver.

By executing and delivering this Agreement, the Client hires the Caregiver to board the Dog for the Client.

2.2. Boarding of the Dog.

Subject to the provisions of this Agreement, the Caregiver shall board the Dog during the Boarding Period.

Article 3 - Duration of Boarding

3.1 Boarding period. The Dog will be Boarded by the Caregiver during the Boarding Period.

The exact date of commencement and termination of the Boarding Period can be amended by an agreement between the Caregiver and the Client.

3.2 Drop Off and Pick Up The Dog shall be brought and/or retrieved from Honey Paws between the hours of 7-9am and 5-7pm unless special arrangements are made between caregiver and client. An additional fee may be incurred for drop off/pickup times outside the designated time frames or may not be available

Article 4 - Boarding Costs

4.1.Boarding cost. The cost of Boarding is up to date on website. If the dog is not retrieved from the Caregiver prior to 9:00 am on the Dog Pick Up Date, a fee will incur. The cost for the Boarding is to be paid in full when the dog is picked-up or returned to the Client. A non refundable non transferable deposit may be required at any time. Rates for the Thanksgiving holiday and December 22-January1 will be an increased details on website. Discounted board may be available for stays exceeding 2 weeks at managements discretion.

4.2. Payment of Boarding and Costs. The Client will pay the Caregiver for the Board of the Dog and any Costs by cash, personal check, or certified check. The Client will make payment to the Caregiver at the time of, or prior to, the Dog Pick Up Date.

4.3 Refund. Subject to the discretion of the Caregiver, there are no refunds for boarding.

4.4 Costs. The Client is responsible for any costs associated with the Dog undergoing veterinary treatment or care during the Boarding Period, which includes but is not limited to: hospitalization, diagnostic testing, and medication. The Client is responsible for any costs associated with the Dog harming another dog that requires veterinary care. During the Boarding Period, the Caregiver will pay the costs associated with the Dog's routine treats and laundry.

Article 5 - Caregiver's Representations and Warranties

The Caregiver represents and warrants to the Client as follows:

5.1. Adequate Housing. The Caregiver has adequate housing for the Dog, which offers the Dog a safe and secure place to reside during the Boarding Period.

5.2. Vaccinations and Parasite Prevention. The Caregivers personal dogs and any animals residing with the caregiver are up to date on all of their vaccinations and parasite prevention.

Article 6 - Caregiver's Covenants

The Caregiver covenants to the Client as follows:

6.1 Residence of the Dog. The Dog shall stay with the Caregiver during the duration of the Boarding Period.

6.2. Housing and Confinement. The Dog shall be housed in an indoor location at all times. The Dog shall be confined in a crate when the Caregiver is not attending to the Dog unless otherwise arranged. The Dog shall sleep in a crate during rest periods and bedtime unless otherwise arranged.

6.3. Feeding. The Caregiver shall feed the Dog the food that was provided by the Client at the times designated by the Client according the information on the "Schedules" page. In addition to Core Meals, the Caregiver may also feed the Dog dog treats during playtime sessions. 6.4 Puppy Play Time and Areas. The Caregiver will utilize areas located at Honey Paws as designated play areas and will walk the dog on leash to and from these areas.

6.5. Equipment. The Caregiver may use the following equipment: flat collar, slip lead, dog leash, and as needed a pet convincer, a pet wand.

6.6. Veterinary Care. During the Boarding Period, if the Dog requires non-emergency veterinary care the Caregiver shall make a reasonable effort to contact the Client so that the Client can obtain veterinary care for the Dog. If after making a reasonable effort the Caregiver is unable to contact the Client, or in the case of an emergency, the Caregiver shall arrange for the Dog to receive veterinary care. A reasonable effort by the Caregiver to contact the Client is communication made by telephone, text message or e-mail. The allotted time for the Client to respond to the Caregiver is determined by the severity of the circumstances of the Dog and is to be decided upon by the Caregiver. The Caregiver may take the Dog to a veterinarian of the Caregivers own choice.

Article 7 - Client's Representations and Warranties

7.1. Owner of the Dog. The Client is the owner of the Dog.

7.2. Vaccinations. The Dog has received the following vaccinations: rabies, DHPP (Distemper, Hepatitis, Parainfluenza, and Parvovirus.) The Dog is up to date on parasite prevention. Bordatella is also strongly recommended.

7.3. Price of Boarding. The price of the Boarding is listed on the website, with an additional fee incurred if the Dog is not retrieved from the Caregiver prior to 9:00 am on the Dog Pick Up Date.

7.4. Supplies and Equipment. The Client will provide the following items with the Dog to be used during the Boarding Period: dog food, flat collar. Client may bring toys, blankets, leash, bowls.

Article 8 - Conditions to the Client's Obligations

The Client is obligated to adhere to the terms of this Agreement, so long as the following conditions are satisfied:

8.1. Representations and Warranties.The Caregiver's representations and warranties must have been true on the date that they were made and must be true as of the Dog Pick Up Date with the same force and effect as though made on and as of the Dog Pick Up Date.

8.2. Covenants. The Caregiver must have performed each of the covenants to be performed by her on or before the Dog Pick Up Date.

Article 9 - Rights of the Caregiver

9.1 Photograph/Video. At any time, the Caregiver has the right to use, reproduce, distribute, and publish any photographs, films, videotapes, audio and video recordings, electronic representations, and sound recordings made during or after the Boarding Period of the Client and the Dog, together or separately. The Client shall not be compensated for the Caregiver's use of the foregoing.

9.2 Electronic Storage. The Caregiver has the right to electronically store any photographs, films, videotapes, audio and video recordings, electronic representations, and sound recordings made during or after the Boarding Period of the Client and the Dog, together or separately. The Client shall not be compensated for the Caregiver's use of the foregoing.

Article 10 - Release and Hold Harmless

10.1. Waiver and Release. The Client waives and releases the Caregiver for any loss, damage or injury to any dog, persons, or property that may occur from any cause as a result of taking part in this boarding activity. The Client recognizes that there may be an element of risk in dog boarding. The Client understands that as the owner of the Dog, the Client is responsible and legally liable for the Dog's actions for the life of the Dog, including the time period during or following boarding. The Client waives and releases the Caregiver from any injury or damage resulting from the action of the Dog. The Client assumes the risk of any such damage or injury during or following the boarding period.

10.2 Indemnify and Hold Harmless. The Client indemnifies and holds harmless the Caregiver from any and all liability or claims the Client may have or that any other person or entity may have because of any death, bodily injury, personal injury, or because of any loss to property that may arise out of or in any way be connected with the Dog's boarding.

Article 11 - General Provisions

11.1.Assignment and Delegation.Neither party may assign its rights or delegate its obligations under this Agreement without the consent of the other party, which party shall not unreasonably withhold its consent.

11.2 Merger. This Agreement states the final and exclusive agreement between the parties regarding the transaction that this Agreement contemplates. It supersedes all previous negotiations and agreements.

11.3 Counterparts. The parties may execute this Agreement in counterparts, each of which constitutes an original, and all of which, collectively, constitute only one agreement. The delivery of an executed counterpart signature page by facsimile or PDF is as effective as delivering this Agreement in the presence of the other party to this Agreement.

11.4 Severability. If any provision of this Agreement is illegal or unenforceable, that provision is severed from the Agreement, and the other provisions remain in effect only if the essential business and legal provisions are legal and enforceable.

11.5. Notices. Except as provided in Article 6.11. the parties shall send all notices in writing and give all consents in writing. A notice or consent is effective when the intended recipient receives it.

11.6. Amendments. The parties may amend this Agreement only by an agreement in writing that both parties execute.

11.7. Governing Law. The laws of Florida, without regard to its conflict of laws principles, govern all matters arising under or relating to this Agreement, including torts.
